MINUTES OF A REGULAR MEETING

 

March 29, 2005

 

The meeting was called to order at 5:30 p.m. by Mayor Ormon Sullivan. 

 

A roll call was taken which showed council members Larry Murray, John Gardner, Guy Coleman, Robert Yack, and Dave Woolstenhulme, present.  The Mayor stated that the meeting was a regularly called meeting and that notice of the time, place and agenda of the meeting had been provided to the local news media and to each member of the governing body.

 

Others present included City Manager Brad Hancock, City Recorder Carolyn Wilcken, Geoff Liesik, Beverly Hansen, Cleve Hatch, Inez Anderton, Teresa Winterton, Garth Winterton, Aery Hurley, Andre Hurley, Alex Niebergall, Ben Niebergall, Colby Ross, Linden Dye, Caleb Hatch, Jean Liddell, Diane Young, Keith Young, Christian Hatch, Roger Eschler, Larry Cohn, Weston Weaver, Troy Collins, Alawna Eldredge, Austin Eldredge, Shane Reary, Leola Freston, Craig Zobell, and Maegen Zobell.

 

Opening remarks were given by Councilman Gardner.

 

MINUTES

 

After review, a motion was made by Councilman Murray to accept the minutes of the meeting of March 15, 2005, after revision.  Motion seconded by Councilman Yack.  Motion carried unanimously.

A motion was made by Councilman Robert Yack to approve the following purchase orders.  Motion seconded by Councilman Dave Woolstenhulme.  Motion carried unanimously.

SEASONAL WORK CONTRACTS

 

Council discussed the seasonal work contracts and directed that the lawn care and restroom cleaning contracts be bid for three year terms beginning with the 2006 season.  A motion was made by Councilman Yack to accept the existing bid prices for the 2005 season as presented.  Motion seconded by Councilman Coleman.  Motion carried unanimously.

 

MAIN STREET REPORT

 

Main Street Manager Beverly Hansen reported that the cost to attend the National Main Street Conference will be $1,500 and Roosevelt City will be reimbursed $750 from the State Main Street Program.  It was reported that George Dean and Roger Eschler have attended this conference in the past and this is where the ideas came from for our new clock and the new lights on Main Street.  Beverly reported on a survey she has undertaken to receive input from the merchants on Main Street seeking their input on ways to improve the business environment.  Roger Eschler will be attending the national conference this year.  Beverly also reported that banners have been ordered to be put on the light poles on Main Street.  The Main Street Committee meets the first Friday of each month at 9:00 a.m.  Tom Ellingsford and Fred Bennett have accepted invitations to join the Main Street Committee.  Beverly also gave Council conceptual plans for the property the city purchased formerly known as Buchanan Feed.

 

OLD PARK & CONSTITUTION BALL

FIELDS USE AGREEMENT

 

Linden Dye came before Council to discuss the Old Park and Constitution Park ball fields and the agreement made with the LDS Church for use of these areas.  The LDS Church representatives have stated the intention to again using the ball fields for their own recreation programs.  Linden explained to Council that it now costs the city $6,993 per year to maintain the Church property at the Old Park ball fields which is part of the existing agreement. Linden was told they want four nights for their program which pretty much eliminates the city’s being able to use this field for city programs.  There is a provision to terminate the agreement that states that the lights purchased by the Church be prorated for the remaining years left in the contract if the contract is terminated.  Linden is seeking direction from Council.  Council stated their desire that President Willard who is the Church’s representative over the park property be contacted to discuss this situation.  A motion was made by Councilman Yack to officially cancel the existing agreement with the LDS Church to use the ball field on Church property in exchange for the City maintaining the property.  Motion seconded by Councilman Gardner.  Councilmen Coleman and Murray voted Nay.  Motion carried.

 

REQUEST FOR LIGHTING AT BALLFIELD

 

Parks Director Linden Dye is requesting lights be installed on the ball field on 10th West and Lagoon which is where he plans to move the girls program.  The cost to do so is estimated at approximately $55,000.  City Manager Brad Hancock was asked to look into this matter.

 

PUBLIC HEARING - COTTONWOOD CREEK

DISCONNECTION REQUEST

 

Citizens from Cottonwood Creek Subdivision are requesting to disconnect from Roosevelt City limits.  They have followed all the required steps in order to do so and the City has scheduled a public hearing to receive input from the public in order to make a final decision.  At the present time, there are enough citizens wishing to disconnect that the mandate requiring 51% has been met.  During the hearing it was asked if one section of the subdivision that is across the street could be removed from the disconnection as the reason for disconnection is so Duchesne County can be approached to pave the subdivision street.  The area section wishing to be removed from the disconnection will not receive any help from the County on roads since their access is directly from the highway.  City Recorder Carolyn Wilcken will research the legalities of reducing the land area involved in the disconnect request and if it is found that it is legal to leave out a portion of the land in the original request to disconnect, it will remain in city limits.  If it is found that this area of land cannot be withdrawn as part of the original request to disconnect, it will remain as part of the area disconnecting from Roosevelt City.  After discussion, a motion was made by Councilman Woolstenhulme to accept the disconnection request within the legal guidelines as researched by Carolyn.  Motion seconded by Councilman Coleman.   Motion carried unanimously.

 

INDUSTRIAL PARK PLAT AMENDMENT REQUEST

 

Bob West came before Council to request an amendment to the Industrial Park Plat.  Planning and Zoning has previously given their approval.  After discussion, a motion was made by Councilman Gardner to accept the amendments to Industrial Park Plat.  Motion seconded by Councilman Coleman.  Councilman Yack abstained.  Motion carried.

 

ALLEYWAY CLOSURE REQUEST

 

Shar Benson came before Council requesting closure of an alleyway located at 400 East at 200 North across the bridge by the carwash.  The City has a sewer manhole located at the end of this alley next to the Gulch and it was felt that it would not be in the best interest of the city to close the alley.  Shar stated that she is making the request for closure so she can build a porch on a home that borders the alley.  Shar was told that it shouldn’t be a problem building the porch as long as it didn’t extend into the alley property.  It was decided that Shar should bring in a drawing of where she wants to place the porch to make sure it doesn’t extend into the alley.

 

FAMILY SUPPORT CENTER

 

Kathryn Larson came before Council asking that the city issue a proclamation supporting Child Abuse Prevention Month during April.  A motion was made by Councilman Yack to proclaim the month of April as Child Prevention Month.  Motion seconded by Councilman Woolstenhulme.  Motion carried unanimously.

 

BUSINESS LICENSE APPLICATIONS

 

Council reviewed business license applications from the following:

D & S Repairs from Donald Klink

Bright Start Childcare from Brenda Cairoli

 

After review and discussion, a motion was made by Councilman Murray to approve these business license applications.  Motion seconded by Councilman Yack.  Motion carried unanimously

 

HOME OCCUPATION PERMIT REQUESTS

 

Council reviewed home occupation permit requests from the following:

 

Trailrock Inc. from Ryan Larsen

Sherm’s Leasing Inc. from Sherm Richens

Tom Seaver Welding by Tom Seaver

 

After review, a motion was made by Councilman Murray to approve these Home Application Requests.  Motion seconded by Councilman Gardner.  Motion carried unanimously

 

FIRE DEPARTMENT FIRE REPORT

 

Fire Chief Lee Rockwood and Assistant Chief Terry Stringham came before Council to report on their 2004 fire statistics.  City Manager Brad Hancock reported that the two relatively new brush trucks have had toxic foam spilled in the tool boxes causing the boxes to corrode prematurely.  They need to be sandblasted and lined with a rubberized coating.  It will cost approximately $1,200 per truck to do this work.  A motion was made by Councilman Murray to approve this to be paid out of the Council Discretionary Fund.  Motion seconded by Councilman Woolstenhulme.  Motion carried unanimously.

 

TRI-COUNTY WALKING/BIKING PATH PLAT APPROVAL

 

A motion was made by Councilman Woolstenhulme to authorize Mayor Sullivan to sign the Tri-County Walking/Biking path plat allowing use of city property as part of the path.  Motion seconded by Councilman Yack.  Motion carried unanimously.

 

EXECUTIVE SESSION

 

A motion was made by Councilman Gardner to go into an executive session to discuss a property matter and a personnel matter and at the end of the discussion, go back into regular session.  Motion seconded by Councilman Coleman.  Motion carried unanimously.

 

GOLF COURSE DRIVING RANGE FENCE REPAIR

 

Moon Lake Electric employees used Moon Lake’s equipment and repaired the driving range fence at no cost to the City.  This would have been very expensive if we had paid to have it repaired.  It has been proposed that the city donate three golf punch passes to Moon Lake to express our appreciation for their work.

 

CITY-WIDE CLEANUP CAMPAIGN

 

Robert Yack – Citywide cleanup is scheduled for April 30 through May 7.  During this period there will be free tippage at the county landfill and K & K has extended free use of their transfer station as long as a utility bill is shown to prove city residency.  These services exclude Sundays.

 

A motion was made by Councilman Murray to adjourn the meeting.  Motion seconded by Councilman Yack.  Motion carried unanimously.
